I believe that thinking about the time period as many removals is crucial to being able to express the magnitude to which the removal of Native Americans created this moment of a power shift. Many of the tribes that were pushed from the East out to the West had solid locations where they had grown trading and adapting to the environment, just for external nations to come in and displace them for the greater good of the new incoming powers. This includes the idea of bringing in slavery into the area and thinking of them as being displaced as well which created a divide in the life experience that many of the slaves lived through as well as Native Americans who suffered a lot between the expansion to the West. This idea of the Untied States expansion and them taking over the land and laws of the country were seen to effect the Native American tribes who had already formed their own ideas of laws to control their own people. Then the governmental identities came in to also become part of the enforcers of the laws that were thought to not include Native Americans as they had created their own way before the settlers arrived. This idea of having Native Americans as part of their society really impacted the idea of power that the United States wanted to obtain by having say in the crimes that were committed in tribes.
As explained in the source named Johnson v. McIntosh the idea that people who had procession of the land weren’t able to move the land around as they pleased simply because the United States had became owner of the land as soon as they formed their government. This can be seen as a type of oppression towards Native Americans as they had been on the land first and should have been able to maintain control and do as they pleased since it was the tribe who decided to sell land. According to the federal government, this position wasn’t valid since the government had no say on the topic and they had already taken a buyer from their own side. This case was very impactful and showed the amount of power that the United States had over tribes and their every day life decisions, as they had to follow United States laws.
